The Supreme Court on Monday morning that called for a new trial for the man convicted of the 1979 kidnapping and murder of Etan Patz, one of the first missing children to be featured on milk cartons.<\/p>\n

The announcement came as part of released from the justices\u2019 June 18 conference. The justices will meet for another conference \u2013 the final regularly scheduled conference before their summer recess \u2013 on Thursday, June 25. The court is likely to release orders from that conference on Monday, June 29, at 9:30 a.m. EDT.<\/p>\n

In 1979, 6-year-old Etan Patz disappeared while on his way to the school bus stop in New York City. He was never found. Patz\u2019s case was among those that led to the creation of the National Center for Missing and Exploited Children.<\/p>\n

Pedro Hernandez was convicted of kidnapping and murdering Patz in 2017. The trial relied on Hernandez\u2019s confession, which he had first made after approximately seven hours of police questioning \u2013 during which he was not advised of his right under the Supreme Court\u2019s 1966 decision in to remain silent and have an attorney present. Police officers then provided Hernandez with a Miranda<\/em> warning, after which he confessed again on video \u2013 the confessions that prosecutors used at Hernandez\u2019s trial.<\/p>\n

While the jury was deliberating, it asked the judge whether it should \u201cdisregard\u201d Hernandez\u2019s confessions after he received his Miranda<\/em> warning if it concluded that his confessions before those warnings were not \u201cvoluntary.\u201d<\/p>\n

After the judge responded \u201cthe answer is no,\u201d the jury deliberated for another week. It eventually convicted Hernandez of felony murder and kidnapping; he was sentenced to 25 years to life in prison.<\/p>\n

After Hernandez\u2019s initial appeals were unsuccessful, he sought post-conviction relief in federal court. He pointed to a 2004 case, , in which the Supreme Court held that a confession repeated after a suspect was interrogated without a Miranda<\/em> warning, confessed, and then given a Miranda<\/em> warning should be suppressed.<\/p>\n

The U.S. Court of Appeals for the 2nd Circuit \u201cagree[d] with the district court that the state trial court\u2019s instruction was clearly wrong under Seibert<\/em>.\u201d Moreover, the court of appeals concluded, that \u201cerror was manifestly prejudicial\u201d to Hernandez. The court sent the case back to the district court for it to order Hernandez\u2019s release or a new trial.<\/p>\n

The state came to the Supreme Court in December, asking the justices to weigh in. The Supreme Court, in McCarthy v. Hernandez<\/em>, \u201chas never held that Seibert<\/em>\u2019s ruling on pretrial suppression extends to jury deliberations.\u201d \u201cNor,\u201d it contended, \u201cwas there any basis to believe \u2026 that the jury was even asking about \u2018the infrequent case\u2019 covered by Seibert<\/em>, because their note referred only to a potential Miranda<\/em> violation, and not to the \u2018deliberate\u2019 strategy to evade Miranda<\/em> that is the indispensable prerequisite for suppression.\u201d Moreover, the state added, requiring a new trial nearly a half-century after Patz\u2019s disappearance will impose \u201csevere costs\u201d and pose \u201cdaunting difficulties.\u201d<\/p>\n

Hernandez that the 2nd Circuit\u2019s ruling \u201cwas based on the straightforward application of this Court\u2019s precedent to the \u2018extraordinary circumstances of this case.\u2019\u201d He emphasized that, \u201caside from those purported confessions, there is no evidence<\/em> linking Hernandez to the disappearance of Patz or even confirming that Patz is deceased.\u201d<\/p>\n

In a 10-page, unsigned on Monday, the court revived Hernandez\u2019s conviction and sentence. It began by emphasizing that federal courts can only grant post-conviction relief if the state court\u2019s decision was \u201ccontrary to, or involved an unreasonable application of, clearly established Federal law.\u201d But in this case, the court said, it was not clearly established under federal law that the trial court needed to instruct the jury in Hernandez\u2019s case about whether it could disregard his confession. And the rule established in Seibert<\/em>, the court continued, did not apply to \u201ca jury\u2019s consideration of a confession that a court has admitted.\u201d<\/p>\n

Moreover, the court added, \u201c[t]he panel\u2019s opinion appears to reflect serious doubt about the reliability of Hernandez\u2019s confessions, but\u201d the federal law governing post-conviction relief for state prisoners \u201cdoes not allow a federal habeas court to disturb a state-court conviction based on such an evaluation of the evidence.\u201d<\/p>\n

Justices Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson indicated, without explanation, that they would have denied the state\u2019s petition.<\/p>\n
