The Supreme Court on Tuesday President Donald Trump\u2019s executive order seeking to end birthright citizenship \u2013 the guarantee of citizenship to virtually everyone born in the United States. In a decision by Chief Justice John Roberts, in Trump v. Barbara<\/em>, the justices agreed with the challengers, as well as all of the lower courts around the country that have considered the issue, that Trump\u2019s order cannot be reconciled with the 14th Amendment to the Constitution, which confers citizenship on anyone \u201cborn \u2026 in the United States, and subject to the jurisdiction thereof.\u201d<\/p>\n

Writing for the majority, Roberts emphasized that the \u201cchildren born of parents unlawfully or temporarily present in the United States\u201d \u201csatisfy both elements of the Citizenship Clause.\u201d \u201cUnder the Constitution,\u201d he concluded, \u201cthey are citizens at birth.\u201d<\/p>\n

In a dissenting opinion, Justice Samuel Alito called the ruling both \u201cone of the most important decisions in the history of the Court\u201d and \u201ca serious mistake.\u201d \u201cCareful analysis of the text of the Fourteenth Amendment and the process that led to its adoption,\u201d Alito argued, \u201cshows that it does not degrade the concept of United States citizenship in this way. Instead,\u201d he contended, \u201cthe Fourteenth Amendment confers citizenship on only those children who, at birth, owe allegiance solely to this country.\u201d<\/p>\n

Trump issued the executive order at the center of the case on Jan. 20, 2025, shortly after he was sworn into office for a second term. It provided that babies who are born in the United States to parents who are in this country either illegally or temporarily are not automatically entitled to citizenship.<\/p>\n

Although Trump\u2019s order was slated to go into effect 30 days after he signed it, it never did. Instead, several federal judges across the U.S. prohibited the Trump administration from enforcing the order while challenges to it moved forward in court.<\/p>\n

Faced with the prospect that Trump\u2019s order could be on hold indefinitely, the Trump administration came to the Supreme Court last spring, asking the justices to weigh in on whether the lower courts can issue \u201cuniversal\u201d or \u201cnationwide\u201d injunctions \u2013 orders that bar the enforcement of laws or policies anywhere in the country. By a vote of 6-3, in\u00a0Trump v. CASA<\/em>, the court that they cannot.<\/p>\n

After the Supreme Court\u2019s decision prohibiting universal injunctions, cases challenging the merits of Trump\u2019s order continued in the lower courts. On July 10, a federal judge in New Hampshire issued a preliminary injunction\u00a0that blocked the government from enforcing the order against a class of\u00a0babies born after Feb. 20, 2025, who are or would be denied U.S. citizenship by the order. U.S. District Judge Joseph Laplante concluded \u201cthat the Executive Order likely \u2018contradicts the text of the Fourteenth Amendment and the century-old untouched precedent that interprets it.\u2019\u201d<\/p>\n

The Trump administration then appealed to the Supreme Court on Sept. 26, it to review Laplante\u2019s ruling without waiting for a federal appeals court to weigh in. The justices granted the government\u2019s request on Dec. 5, and the case was argued on April 1.<\/p>\n
