If you have a federal clerkship and significant appellate or commercial litigation experience, send a brief note explaining why you&#8217;re interested, along with your resume, to <span>[email\u00a0protected]<\/span>.<\/p><div><h2>At the Court<\/h2><div><div><div><p>The Supreme Court Building will be closed on Friday in observance of the Independence Day holiday.<\/p><\/div><\/div><\/div><\/div><div><h2>Morning Reads<\/h2><div><div><h3>Supreme Court sends GOP in Congress scrambling over birthright citizenship<\/h3><p>Zachary Schermele, USA Today<\/p><div><p>After the Supreme Court struck down his executive order limiting access to automatic citizenship at birth, President Donald Trump \u201curg[ed] congressional Republicans to move quickly on legislative action to restrict or end birthright citizenship.\u201d \u201cThe barriers to such a gambit, however, are many,\u201d including that Congress may not be able to override the ruling without a constitutional amendment, \u201cwhich would require two-thirds of Congress to approve and states to ratify,\u201d according to USA Today. \u201cIf it requires a constitutional amendment, maybe we work towards that,\u201d House Speaker Mike Johnson, a Republican from Louisiana, said this week. \u201cIf there\u2019s something to do statutorily, maybe we do that as well.\u201d<\/p><\/div><\/div><div><h3>Amy Coney Barrett Faces Right-Wing Ire Over Recent Rulings<\/h3><p>Emily Davies, The New York Times<span><svg><\/svg><\/span><\/p><div><p>The Supreme Court\u2019s final opinion announcement days fueled \u201ca torrent of attacks from right-wing commentators\u201d against Justice Amy Coney Barrett, who sided against \u201ctwo key pillars of the Trump administration\u2019s agenda\u201d \u2013 limiting access to birthright citizenship and restricting mail-in voting \u2013 in two of the court\u2019s final rulings, according to The New York Times. \u201cProminent G.O.P. officials and pundits cast Justice Barrett\u2019s votes as part of a pattern of betrayal of Mr. Trump and the Republican Party.\u201d However, \u201cother conservative commentators praised her for what they saw as a principled approach to a job that should rise above the political fray.\u201d<\/p><\/div><\/div><div><h3>Transgender people finding it hard to win at US Supreme Court<\/h3><p>Andrew Chung, Reuters<span><svg><\/svg><\/span><\/p><div><p>On Tuesday, the court \u201c transgender student athletes, permitting state laws banning them from participating on female sports teams at public schools including universities.\u201d The decision \u201crepresented another setback for transgender people fighting a growing array of state and federal restrictions targeting them,\u201d as well as a series of Supreme Court losses on such issues as medical treatments for transgender minors and military service, according to Reuters. But some advocates for transgender rights found a silver lining in Tuesday\u2019s ruling, contending that it \u201cwas narrowly focused on the sports context and that its reasoning did not foreclose successful challenges to other restrictions on transgender people.\u201d<\/p><\/div><\/div><div><h3>Lawyer for E. Jean Carroll says Trump wants to delay $5 million payment in sex abuse, defamation case<\/h3><p>Graham Kates, CBS News<\/p><div><p>On Monday, the Supreme Court announced that it will not hear President Donald Trump\u2019s challenge to a $5 million jury verdict entered against him in a sexual abuse and defamation case brought by E. Jean Carroll. His legal team has since signaled that it plans \u201cto ask the Supreme Court to reconsider his appeal,\u201d and \u201casked for &#8230; Carroll\u2019s consent to delay\u201d payment of the $5 million, according to CBS News. \u201cCarroll\u2019s lawyer, Roberta Kaplan, wrote in a court filing Tuesday that Mr. Trump\u2019s lawyer called her with the request Monday, soon after the Supreme Court declined to hear his appeal. Later Monday, Kaplan wrote, she informed Mr. Trump\u2019s team that \u2018Carroll does not consent,\u2019 and asked whether the president would agree to the immediate disbursement of the funds,\u201d which are \u201cheld in a court-controlled bank account.\u201d<\/p><\/div><\/div><div><h3>Donald Trump is on a Supreme Court losing streak. Yes, really.<\/h3><p>Kyle Cheney and Josh Gerstein, Politico<\/p><div><p>During President Donald Trump\u2019s second term, through decisions on its argument and interim dockets, the Supreme Court has supported the president\u2019s \u201cbid to expand presidential power, especially over the federal workforce, and to gut a slew of laws meant to insulate some appointees from political pressure. It has allowed him to fire tens of thousands of people, cancel billions in federal grants and dramatically downsize federal agencies.\u201d And yet, according to Politico, \u201cthe justices have stiff-armed Trump over and over again on his unique <em>personal<\/em> priorities \u2013 the issues he talks about most often, and most passionately,\u201d such as tariffs and birthright citizenship.<\/p><\/div><\/div><\/div><\/div><div><h2>On Site<\/h2><div><div><div><div><span>Stat Pack<\/span><h3>The 2025-26 term by the numbers<\/h3><p>By <!-- -->Jake S. Truscott &amp; Adam Feldman<\/p><p>By several measures, this term was more ideologically divided than the last one. Last term, 15.2% of the court\u2019s decisions were decided by a 6-3 vote, and 9% of all decisions were 6-3 ideological splits. This term, those figures rose significantly, to 28.8% and 22.7%, respectively. The liberal justices also dissented together more often, moving from 15% of cases to 24.2%. The petitions generally face one of five fates: rescheduled, relisted, held, granted, or denied.<\/p><p>If a petition is relisted, it means the justices have considered it at one or more conferences and want to consider it <em>again<\/em> at their next one (typically, cases are not granted unless they have been relisted at least once). Since the clean-up conference is the last conference before the justices\u2019 summer recess, the court typically addresses the remaining relists, whether by granting them, denying them, or holding them, and starts the term in the fall with a clean slate.<\/p><p>If a petition is held, it means the justices are choosing to sit on it, often because the petition raises a legal question that is similar to one already being decided by the court. Once it rules in the related case, the court can then deal with the held petitions. Some of these get \u201cGVR\u2019d,\u201d meaning the court grants the petition, vacates the lower court\u2019s decision, and remands the case to the lower court for reconsideration in light of a new opinion. In Tuesday\u2019s  from this year\u2019s clean-up conference, the justices issued seven GVRs.<\/p><p>Beyond the GVRs, the clean-up conference has in recent years also become a venue for the justices to grant new cases for the upcoming term \u2013 and sometimes very significant ones. At the court\u2019s June 2023 clean-up conference, the justices added seven new cases to the next term\u2019s argument docket, including <em>United States v. Rahimi<\/em>, a Second Amendment challenge over whether a federal ban on gun possession by individuals subject to domestic violence restraining orders violated the Constitution. A year earlier, the clean-up conference produced three new grants, including <em>Moore v. Harper<\/em>, about the power of state legislatures over federal elections. This year, the justices took up four cases during the clean-up conference (although two were consolidated), agreeing to weigh in on such issues as whether the Second Amendment protects possession of semiautomatic rifles.<\/p><p>The clean-up conference has also historically tended to produce a \u201cvariety of separate opinions addressing or dissenting from the court\u2019s orders,\u201d in which certain justices disagree with the decision to hear, or not hear, a case.<\/p><p>One final thing: the clean-up conference should not be confused with the \u201clong conference,\u201d which the justices hold in late September or early October after their recess ends. At that conference, the justices go through the many petitions that accumulated over the summer and get ready to \u201cwelcome\u201d in the new term.<\/p><\/div><\/div><div><h2>SCOTUS Quotes<\/h2><div><div><p>\u201c[A]s to competitive fairness, allowing biological males to play on women\u2019s and girls\u2019 sports teams can put female athletes at a serious disadvantage.
