U.S. Solicitor General D. John Sauer called an order by a federal judge in Massachusetts that paused portions of the order in 23 states and the District of Columbia \u201cextraordinary,\u201d and he argued that it \u201cflouts settled\u201d doctrines governing when courts can weigh in on a dispute.<\/p>\n<p>Read more <a href=\"https:\/\/americanservicereview.com\/?p=440\">Why the Supreme Court decided the wrong issue in the transgender athletes cases<\/a><\/p>\n<p>Sauer also asked the court to issue an immediate administrative stay \u2013 an order that temporarily puts the lower court\u2019s order on hold while the justices consider the government\u2019s request.<\/p>\n<p>Trump signed the executive order at the center of the case, titled \u201cEnsuring Citizenship Verification and Integrity in Federal Elections\u201d on March 31 of this year. Among other things, the order instructs the U.S. Postal Service to propose rules for mail-in and absentee ballots, and it directs the Department of Homeland Security to compile \u201cstate citizenship lists\u201d \u2013 lists of individuals in each state who are U.S. citizens over the age of 18. Under the order, the rules issued by the USPS must provide that the Postal Service can only send mail-in ballots to voters whose names appear on the state citizenship lists.<\/p>\n<p>A group of 23 states and the District of Columbia, led by California, went to federal court in Massachusetts to challenge the implementation of the order. They argued that the order conflicts with provisions in the Constitution that give states the power to determine voter eligibility and to set the \u201cTimes, Places, and Manner\u201d of holding congressional elections.<\/p>\n<p>U.S. District Judge Indira Talwani agreed and on June 25 issued  that prohibited the federal government from implementing the mail-in ballot and state citizenship list provisions for the Nov. 3, 2026, elections in the states that had filed the lawsuit.<\/p>\n<p>Read more <a href=\"https:\/\/americanservicereview.com\/?p=439\">Justices\u2019 lucrative book deals deserve more scrutiny<\/a><\/p>\n<p>In an order issued on Saturday, a divided panel of the U.S. Court of Appeals for the 1st Circuit  the government\u2019s request to intervene. If the order were \u201cto take effect for the elections taking place\u201d in the fall, the majority wrote, \u201cit would sow confusion and threaten disenfranchisement of many eligible voters.\u201d<\/p>\n<p>The Trump administration then came to the Supreme Court on Monday, asking the justices to step in. Sauer argued that the courts should not yet consider the states\u2019 lawsuit because the agencies haven\u2019t yet decided how they will implement the order.
