{"id":562,"date":"2026-08-25T20:10:56","date_gmt":"2026-08-25T20:10:56","guid":{"rendered":"https:\/\/americanservicereview.com\/?p=562"},"modified":"2026-08-25T20:10:56","modified_gmt":"2026-08-25T20:10:56","slug":"trump-administration-asks-justices-to-consider-key-border-policy","status":"publish","type":"post","link":"https:\/\/americanservicereview.com\/?p=562","title":{"rendered":"Trump administration asks justices to consider key border policy"},"content":{"rendered":"<div>\n<p>The Trump administration on Monday  a ruling by a federal appeals court in Washington, D.C., that bars the federal government from removing immigrants who crossed the U.S.-Mexico border illegally without giving them a chance to seek asylum. U.S. Solicitor General D. John Sauer told the justices that the decision by the U.S. Court of Appeals for the District of Columbia Circuit \u201cthreatens to dismantle\u201d what Department of Homeland Security Secretary Markwayne Mullin \u201cdescribes as an \u2018indispensable\u2019 tool for controlling the border.\u201d<\/p>\n<p>Read more <a href=\"https:\/\/americanservicereview.com\/?p=561\">The justices should regularly sit on the lower courts<\/a><\/p>\n<p>The dispute centers on a proclamation that President Donald Trump issued shortly after his inauguration for a second term. The proclamation indicates that because \u201c[t]he sheer number\u201d of noncitizens \u201centering the United States has overwhelmed the system\u201d and \u201cprevents the Federal Government from obtaining operational control of the border,\u201d \u201cthe current situation at the southern border qualifies as an invasion.\u201d The proclamation instructs immigration officials to quickly remove immigrants who cross the border illegally without providing them with the process or protections to which they would normally be entitled \u2013 including the right to seek asylum.<\/p>\n<p>A group of immigrants and three immigrants\u2019 rights groups went to federal court, where they argued that the proclamation (as well as guidance issued to implement it) violate federal immigration law.<\/p>\n<p>In , U.S. District Judge Randolph Moss blocked the Trump administration from imposing the restrictions on removal and asylum. He \u201crecognize[d] that the Executive Branch faces enormous challenges in preventing and deterring unlawful entry into the United States and in adjudicating the overwhelming backlog of asylum claims of those who have entered the country.\u201d But neither the Constitution nor federal immigration law, Moss ruled, allow the president \u201cto adopt an alternative immigration system.\u201d<\/p>\n<p>On April 24, the D.C. Circuit upheld Moss\u2019 ruling. Judge J. Michelle Childs explained that the \u201ctext, structure, and history\u201d of federal immigration law \u201cmake clear that,\u201d although Congress may have given the president the power to temporarily block immigrants without proper documentation from entering the country, it did not give Trump the \u201cexpansive removal authority\u201d that he claims in the proclamation. Both the proclamation and the agency guidance, Chiles concluded, therefore violate federal law insofar as they bypass the normal deportation process \u201cand cast aside federal laws affording individuals the right to apply and be considered for asylum or withholding of removal,\u201d which is a more limited form of protection from deportation than asylum.<\/p>\n<p>Read more <a href=\"https:\/\/americanservicereview.com\/?p=560\">SCOTUS sides with Trump administration in mail-in voting dispute<\/a><\/p>\n<p>Sauer told the court on Monday that before the president\u2019s proclamation went into effect, the U.S.-Mexico border \u201chad become overwhelmed by an ungovernable influx of millions of aliens, creating chaotic conditions that criminal and terrorist organizations exploited to threaten our national security.\u201d The restrictions imposed in the proclamation, Sauer said, have been \u201c[t]he most important and effective pieces of the President\u2019s response\u201d to that influx. Although the D.C. Circuit\u2019s decision is currently on hold, allowing the government to maintain the asylum restrictions, Sauer warned that \u201call of the progress\u201d that the government has made \u201crisks evaporating if the ruling below is allowed to take effect.\u201d<\/p>\n<p>Sauer pointed to the Supreme Court\u2019s 2018 decision in , in which the justices upheld the Trump administration\u2019s \u201ctravel ban,\u201d a 2017 executive order that restricted immigration to the United States by citizens of eight countries, most (but not all) of which are predominantly Muslim.\u00a0In that case, Sauer emphasized, the justices agreed \u201cto review a lower-court decision curtailing the President\u2019s power to control the flow of aliens into the country. The same result is warranted here.\u201d Indeed, Sauer added, \u201c[t]his case is even more important\u201d than the travel ban case.<\/p>\n<p>The Supreme Court should also step in, Sauer continued, because the lower courts allowed the case to move forward as a class action that would, if the challengers prevail, benefit \u201can astoundingly broad class\u201d of plaintiffs, including noncitizens \u201cwho are currently overseas and have no imminent plans to enter the United States (much less enter illegally).\u201d By approving an \u201ceffectively universal class\u201d of plaintiffs, Sauer argued, the lower courts made \u201ca transparent end-run around\u201d last year\u2019s ruling in <em>Trump v.
